Fort Benton Man Pleads Guilty to Homicide

Charles Lundy admitted he killed John Wendell today (9/7) in Chouteau County Court. He was initially charged with deliberate homicide and tampering with evidence but today plead guilty to a lesser charge of mitigated deliberate homicide. Last September, Lundy and the victim were practicing quick draws with a pistol when Lundy says he accidentally shot Wendell in the head. Afterwards he moved the victim's body. Lundy was under the influence of drugs and alcohol at the time. If the judge accepts a plea agreement worked out with Chouteau County Attorney Steve Gannon, Lundy will serve 45 years in prison with the possibility of parole after eleven years. The judge will decide his fate December 16th.

Bull Crap! I don't think it was an accident. Quick draw accident is shooting someone in the body, arm, etc., but the head. Give me a break. Lundy has been under the influence for many, many years. Anyone who knows him will agree as to how unstable his thinking has been.

After reading the coverage that has been posted, it sounds as tho they were equally at fault for being in possession or near a weapon where alcohol and/or drugs are present. I know of many adjudicated cases where people were under the same duress and received a sentence no where near this one. I have to agree with J. Willis that this sentence of 45 years is mostly for tampering with evidence.
