Former Jailer Avoids Jail in Sex Crime Plea

A former Cascade County jailer charged with having sexual intercourse with a minor without consent is entering into a plea agreement on a lesser charge. 19-year-old Zachary Henrie of Ulm agreed to plead guilty to one count of criminal endangerment for having sex with a 15-year-old girl. That’s in spite of the fact that Henrie said the victim gave her consent. However, under Montana state law--anyone under the age of 16 cannot give legal consent to sexual activity. Today (6/17) the teenage girl took the stand and tears filled the courtroom. She testified under oath Henrie lied to her. She said her life would never be the same because he took her childhood. She did agree to go along with the plea agreement because she didn't want to go through a trial. The former jailer will avoid jail and serve a three year suspended sentence. He will also have to pay restitution.
