A Lewistown man accused of taking a 14-year-old runaway girl across state lines, says he is not-guilty, and has waived his right for a detention hearing.

Donald Cates is accused of traveling from Pennsylvania to Arkansas with an underage girl he met online. Cates was accused of raping five girls in Fergus County in 2005, but a judge ruled that case a mistrial.

The FBI says Cates came to Erie, Pennsylvania in April to meet the young girl, and coerced her into sexual conduct that was recorded on video.

They were caught four days later in Clarksville, Arkansas, when someone saw them trying to hitch a ride, and called the police.
Cates could have sought to be released from jail at a detention hearing, but yesterday waived that right.

A recent Montana Supreme Court decision ruled it would not be double jeopardy to try Cates again for the 2005 rape charges. He is scheduled to appear in Fergus County Court in late July.
