The case against a Great Falls man accused of playing a role in an infant's death has now been dismissed. Thomas Allen Tallbull was charged in April with felony Criminal Endangerment after allegedly crushing a 7-week old infant in his sleep, after a night of drinking.

His trial was scheduled to begin this morning, but Deputy Cascade County Attorney Steve Bolstad filed a motion to dismiss this case on Friday.

According to Bolstad, the cause of the baby's death was undetermined, and there was no physical evidence indicating that the infant suffocated.

Court documents say the baby's mother, who is a registered nurse, returned home after working a night-shift in April and found her son dead. She later told authorities that the baby's death was plainly explainable, and he was not crushed.

The motion to dismiss the case states that Tallbull showed "significant remorse" and satisfied requirements set forth by the state and his tribe, including chemical and emotional counseling and enrollment in alcoholics anonymous.
