The Federal Government is asking a judge to dismiss a lawsuit that seeks to exempt guns made in Montana from national gun control.

Last year gun advocates in Montana filed a lawsuit claiming the state should decide which rules would control the sale and purchase of guns made in Montana.

Any guns made here that stayed in the state would be exempt from the rules on federal gun registration, background checks, and dealer licensing.

This week - the Department of Justice filed a brief that said federal gun control is a valid exercise of the commerce power that congress has under The Constitution. But advocates say if the gun never crosses state lines - then the government should not have control.

The 2'nd amendment is so the States can protect themselves from the Federal Government! National Guard can be Federalized! The Fed has no business meddling for this reason!

John--few people seem to know thatmore people in the civil war were fighting about state's rights (even the Cherokee Indians were in on it for that) but sadly, the side for states' rights lost.

It amazes me that we even have to have this argument. What part of shall not be infringed do all you people not understand. All laws that regulate or control guns in this nation are unconstitutional period.

The Feds need to watch their shtep when they decide to go against the Constitution and impose themselves aginst state soverignty. Eventually the states will get fed us with it and segregate themselves from the Union. What a state government chooses to do within its boundaries is that states bussiness and no one elses.

EXACTLY!! There should be no need what-so-ever for ANY State to have to file a lawsuit. NONE. If only enough States gathered together when the Feds tried to brow-beat their way in and said simply " I'd like to know just what the hell you think your doin? And give them a very simple ultimatum, Butt out or suffer the consequences. We wouldn't have to waste any money.

You cannot control a constitutional convention. Once it starts everything is up for grabs. Don't even think of going there. There is doubt that a State can recall its request for a constitutional convention. we are one step away from our worst dream!

The interstate commerce clause was meant to prevent states from imposing tariffs on other states' goods. It was never meant to allow the Feds to regulate anything and everything that they want. We are one state away from a Constitutional Convention and we can correct a lot of bad decisions by the Supremes.

The federal govt wants Montana (and all states) to ignore illegal immigration laws. Why not the same deal for guns? This country is totally screwed up! i really hope everyone in Montana prevails! Keep up the good work everyone. The rest of the country is pulling for you.

We fought a war inside the U S called the civil war. it was the war for states rights. Or so I though. Now Oboma government wants take our wrights away

They (The Federal Govenment) always want to control, control and then control alittle more each day. Let Montana run Montana and the Dept of Justice should read the Constitutution again and understand that its is about States Rights.
