Katka to Remain in State Hospital Until Final Ruling

The ACLU hearing involving an 18-year-old state prison inmate's allegations of mistreatment continued for a fourth day in Helena.

Some witnesses say Raistlen Katka suffers from depression and anti-social personality disorder but others argue that he does not suffer from a serious mental illness.

The state prison psychiatrist says Katka has expressed interest in turning his life around but he does have a history of gang involvement.

Mike Mahoney, The Montana State Prison Warden says “so let's not delude ourselves by saying oh jeez he's denouncing gangs. that's BS he's not denouncing gangs, he feels he needs that support because if he's in trouble with the "Nortenos" or if he's on the streets or he's at Montana State Hospital and he's really fearful of what happened to him in Montana State Prison - that to me is a good indicator that we need to work diligently from a treatment standpoint on dealing with this gang stuff.”

Pending the court's decision, Katka will remain at the Montana State Hospital; Judge Sherlock will have a final ruling in the coming weeks. If there is any reason that Katka must return to the Montana State Prison, the court must have a ten day notice, however if there is an emergency situation, if Katka acts out, then the state hospital can make the appropriate decision to return him to the state prison.

Judge Sherlock warned Katka that this was his break and he needed to exercise good behavior.

Of course he will be good. He is playing the system. He does not want to be at MSP because he will become someone bunkmate.
