Rock Boy Tribal Council Members File Lawsuit to Stop Elections

Candidates running for Tribal Council on Rocky Boy's Reservation have filed a lawsuit to stop the elections from happening tomorrow.

The group, made up of candidates who lost in the primary, wants to overturn last month's primary results saying one winning candidate is ineligible.

Tribal Council member Stacy Small is a plaintiff and says this is not a personal attack, he just wants to uphold election ordinances as they are written in their constitution.

The suit claims Neal Rosette was charged with a felony less than five years ago making him an illegal candidate.

Rosette argues his charge for forgery by common scheme was dismissed after he served a two year probation. Rosette says he wouldn't have run if he thought he was ineligible.

“I made a mistake, I admitted to the judge that I made a mistake early on and paid the price and have put it behind me. Now, I know they keep bringing it up, but if you look at the record and see Judge Rice's signature on it, my record says the case is dismissed, which essentially means it never happened,” Rosette says.

At last check, Chief Judge Joel Rosette was reviewing the case and the elections will still be held tomorrow as scheduled.
