Man gets 42 years in pistol-whipping over stolen drugs

By The Associated Press

GREAT FALLS - A 35-year-old Browning man has been sentenced to just over 42 years in prison, for the pistol-whipping of two people whom he believed had stolen illegal drugs from him.

Shane Maggi was sentenced Monday by U.S. District Judge Sam Haddon. A jury found Maggi guilty of two counts of assault with a dangerous weapon and two counts of the use of a firearm during the commission of a crime of violence.

Court records say Maggi beat Kelly and Kimberly Hoyt with a pistol on May 16, 2007 and discharged the pistol into a wall over the head of Kelly Hoyt. Maggi was on state probation for a previous felony conviction at the time of the attack and had recently been arrested in a vehicle which contained a firearm, a violation of his probation.
