The case charged that Les Schwab failed to stop Earle Nevins' co-workers from calling him derogatory names and making insulting jokes about Native Americans. When Nevins complained, he was told his co-workers were engaging in "horseplay."

The EEOC lawsuit, filed in 2006, also charged that Nevins, a member of the Blackfeet Nation, was illegally fired in retaliation for repeatedly complaining about the harassment. Les Schwab denied any wrongdoing. Company spokeswoman Jodie Hueske says the company was pleased to resolve the issue and end the expense of the litigation.

Les Schwab also agreed to implement anti-discrimination policies and procedures and provide anti-discrimination training to all employees at its store in Kalispell
