Attorney asks court to move attempted murder case

BOZEMAN - An attorney for a man charged with attempted murder after a fight behind a Bozeman bar has asked for the case to be moved because he says his client can't get a fair trial with a local jury.

Prosecutors say 27-year-old Miles Kingman and his roommate, Ryan Dibert, severely beat 30-year-old Paul Overby on Sept. 17. Charging documents say every bone in Overby's face was broken during the fight.

Kingman's defense attorney, Eric Brewer, says "prejudicial pretrial publicity" since the incident has tainted the local jury pool. Brewer is asking the court to move the trial out of Gallatin County or bring an outside jury in to hear the case.
