Settlement reached, girl run over by bus

By The Associated Press

BUTTE - A settlement has been reached in a lawsuit filed against Butte's Head Start program by the mother of a 3-year-old girl who died after being run over by a bus.

The executive director of the Human Resources Council District that oversees Head Start confirmed that a confidential settlement was reached the end of October.

Investigators determined the death of Eternity Ann Hamburg was caused when the tires of a Head Start bus rolled over her on Nov. 16, 2006, shortly after she was dropped off.

The lawsuit filed by Chasity Hodges alleges the bus driver and bus assistant negligently failed to keep a proper lookout for Eternity and failed to make sure she was far enough away from the bus and under the control of an adult before the bus started to move.
