Attorneys Seeking Sherry Arnold Case to Be Moved to Bozeman

Posted: Updated:

Attorneys for one of the two men charged in the death of Sidney High School teacher Sherry Arnold are working towards having his trial moved to Bozeman.

Michael Keith Spell and Lester Van Waters, Jr., both of Colorado, have pleaded not guilty to charges that state they grabbed Arnold from a Sidney street, killed her and buried her body in a North Dakota field.

Spell's attorneys filed court documents earlier this month and say Arnold's popularity and widespread news reports about a confession by Spell have biased potential jurors in eastern Montana. The attorneys say they conducted a survey that showed three-quarters of potential jurors in the Sidney area believe Spell is guilty. Spell's attorneys are also seeking to have his confession suppressed because he is mentally disabled.
