Posted: Updated:

Around 10:40 Wednesday night the Montana Highway Patrol arrived to a scene where a bicyclist was hit and killed by a drunk driver. The accident happened at the 3500 block of Montana avenue.

"The scene was chaotic, you know this is a heavily traveled route, this route is used a lot by bicyclists and people coming in and out of the valley, it is a very heavily traveled route" says Sgt. Jay Nelson from the Montana Highway Patrol.

The victim was identified as 29-year-old Benjamin John Homan from Helena, who after was taken to St. Peters Hospital where he was pronounced dead even though he was wearing all safety gear. The drunk driver of the vehicle first hit Homan and drove off, then stopping a few blocks later and admitting to the accident.

The driver was Joel Powers who made his initial court appearance earlier today. Powers is facing four charges including vehicular homicide while under the influence and felony aggravated DUI.

The Montana Highway Patrol is joined by the Helena Police Department here at the scene again today to continue the investigation and to find out how fast exactly the vehicle was going during the accident.
