Posted: Updated:

We bring you the latest in the Shannon Augare traffic stop case.  After being stopped in the spring under suspicion of DUI, the Senator reportedly told a Glacier County Sheriff's Deputy that he had no jurisdiction before driving off.

Court proceedings taking place this morning for the State Senator from Browning.  Augare's Attorney, Joe McKay, arguing that the tribe has exclusive jurisdiction over alleged crimes that take place on reservations.

Augare was charged with driving under the influence, reckless driving, and obstructing a peace officer after the reported incident during a traffic stop by the Glacier County Sheriff's Office in May while on the Blackfeet Reservation.

McKay asked Judge Keith Strong to dismiss the charges during today's hearing arguing the jurisdiction.  A Blackfeet Attorney says over 200 years of tribal laws would be upended if the government is allowed to prosecute a tribal leader for a crime committed on the reservation.

Augare plead not guilty to all charges back in July.  McKay says he will make a ruling soon on jurisdiction, possibly as soon as the end of next week.
