Montana Joins 26 States in Supreme Court Brief regarding Firearm Sales

In Helena Attorney General Tim Fox announced that Montana has joined 26 other states and territories in an amicus brief filed in the U.S. Supreme Court. It argues that the federal government is overstepping the law by trying to prohibit firearms sales between private parties.

The brief opposes the federal government's attempt to prosecute gun owners that wish to sell firearms to other legal gun owners. The brief refers back to the Abramski V U.S. Case where Bruce Ambramski was charged with selling a legally purchased firearm to a family member who could legally obtain it.

"When these type of situations come up where the federal government takes an overly broad view of a law that violates the constitution or otherwise over reaches and impedes the states right to regulate these things that's what Attorney Generals stand up for their citizens and that is what I am doing here for Montanans." says Attorney General Tim Fox.

The oral arguments for the case is scheduled for January 22nd with a final decision to come by the end of the court's session in June.
