A Man Accused of Being Involved With a Runaway Makes His First Appearance

After his reported involvement with a runaway child, a man made his initial appearance for charges of sexual intercourse without consent, obstructing justice and two counts of endangering the welfare of children.

Court documents claim the following: On December 19th, Detective Garner was assigned to a follow up on the investigation of a 14 year old runaway believed to be with John Nemetz.

The mother then contacted Nemetz over Facebook, where he denied knowing where her daughter was. Detective Garner later received a phone call from him, claiming that he had not seen the girl and was in Missoula taking care of his sick father. Garner then confronted him about another officer receiving phone calls from the missing girls phone, and witnesses claiming they saw them together, but Nemetz denied all allegations.

On December 20th, the victim was apprehended, after her mother told police that her daughter contacted a friend to borrow money at Gibson Park.

On December 21st, the girl was reported as a runaway again. Police located her and Nemetz at Zip Trip. Nemetz told police he had just met the girl, and he thought she was 18 years old. But later he changed his story, saying he had seen her several times. Unaware of the prior runaway report, police released Nemetz, and the girl was taken to Benefis.

Later in a forensic interview, she admitted to using marijuana with Nemetz, having sexual intercourse with him, and being in his home during the time she was listed as a runaway. She also told police that Nemetz was aware of her age, and runaway status.

Nemetz's interview went a lot differently. He claimed he was never with her as a runaway. Then he changed his story, saying that he was with her, but just for two nights. He then claimed he didn't know she was going to be at Zip Trip, and then changed the story once again, stating he meet her there to discuss their relationship.

Nemetz has previous misdemeanor convictions and one felony burglary conviction. In light of these events and previous charges, his bail has been set at $50,000.
