    SPOKANE, Wash. - KHQ has confirmed that Spokane Police Major Crimes detectives made no charging recommendations for a fatal shooting that happened in March.
    SPOKANE, Wash. - KHQ has confirmed that Spokane Police Major Crimes detectives made no charging recommendations for a fatal shooting that happened in March. Their report was submitted to the Spokane County Prosecutors on May 13th.

It’s been almost exactly a year since Gail Gerlach fired a single, deadly shot into his Suburban as it was being driven away by Brendan Kaluza-Graham, and Wednesday Gerlach was back in court as his manslaughter trial is just weeks away.

In a pre-trial hearing held Wednesday morning, Judge Annette Plese made rulings about which of Gail Gerlach’s statements to police can be allowed at trial. Based on prior case law – both here in Washington and in the Supreme Court – she ruled that the statements Gerlach made to police on the morning of March 25, 2013, are admissible, up to the point at which a police officer recommended Gerlach get a lawyer. She also ruled any statements made after Gerlach told investigators he did not want to speak further about the events that unfolded are inadmissible.

Wednesday’s hearing was expected to be the last before Gerlach’s trial begins with jury selection on the morning of March 31st. Due to the publicity of the case, the court will pull 100 potential jurors; anyone with preconceptions about innocence or guilt in the case will not be allowed to take part.

The trial is expected to last 6-10 days, with jury selection taking a full day and the state requesting 4-5 trial days to present its case before the defense begins calling witnesses. If convicted of first-degree manslaughter, Gerlach could face a maximum of 11 years in prison, a $50,000 fine, or both.
