State responds to Markus Kaarma's appeal

The state responds to an appeal made by a Missoula man convicted of deliberate homicide in the shooting death of a German foreign exchange student.

Markus Kaarma argues that jurors were not properly instructed about justifiable use of force and that pre-trial news coverage biased the jury, and the judge was wrong in failing to dismiss a juror who was married to a retired Missoula Police Officer. He also added that the judge was wrong for allowing his girlfriend to testify that he previously assaulted her.

The state said in response that jurors in fact, did receive proper instructions, biased jurors were weeded out through a questionnaire, and a previous testimony opened up the door to questions about the assault on his girlfriend.
