VERO BEACH, Fla. - A Vero Beach, Florida, man was arrested last month on DUI charges, but he told police he wasn't drinking and driving, he was only taking hits of bourbon while at stop lights and stop signs.

Earle Stevens, Jr. smelled of booze and had an open bottle of liquor in the passenger seat of his car when he was arrested on June 27, according to an arrest report.

Sheriff's deputies responded to a McDonald's in Indian River County after a woman reported that a man behind her kept hitting her bumper. When deputies arrived on scene, the woman pointed to a car with Stevens in the driver's seat. When deputies went to talk to him, he told them he felt "pretty good" and was drinking Jim Beam from the bottle, but only when his car was stopped, according to the report.

"He further explained that he was not drinking while the car was moving and only when he stopped for stop signs and traffic signals," the arrest report said.

Deputies report Stevens' blood alcohol content was measured at 0.153 and 0.147. He was booked into jail on charges of DUI and driving without a license.
